PlayStation’s Timing for Digital Game Ownership Reminders Raises Eyebrows Among Players
Sony is still facing backlash from its controversial announcement to discontinue new PlayStation discs by 2028, a decision revealed earlier this summer. Despite expressing no intention to reverse this unpopular move during a recent earnings call, the discontent among fans continues to simmer online. Compounding the situation, the company sent out automated reminders of its terms of service this week, which included the unsettling detail that players don’t actually own their digital games.
An email shared on the PlayStation Solutions subreddit on August 18 stated, “You recently accepted the following PlayStation terms (the “Terms”): PlayStation Terms of Service, PlayStation Code of Conduct, PlayStation End User License Agreement, PlayStation Privacy Policy. For your convenience and future reference, we have included full copies of the Terms in this email. Please retain this email for your records. The Terms set out important information about your rights and obligations when using PlayStation.”
Many users were puzzled by the sudden arrival of this email, especially those who hadn’t logged into their PlayStation 4 or PS5 in months. Instead of simply linking to the legal documents, the email included detailed sections, such as section 1.4 of the Software End User License Agreement titled “License to you,” which pertains to digital purchases—the only way to acquire new PlayStation games starting in January 2028.
“The Software is licensed to you, not sold,” it states. Players receive a limited, non-exclusive, non-transferable, and personal license to use the Software for private, non-commercial purposes on the intended system or device. This license is effective only from the specified Software release date, early access date, or beta release date. Any rights not explicitly granted in this license are reserved, including all intellectual property rights in the Software. The terms also outline various restrictions on digital games, such as prohibiting players from renting, leasing, modifying, or obtaining the Software through any means other than authorized distribution methods.
The #PSBlackout is set to kick off tomorrow! Advocates for physical games are rallying against a digital-only future that lacks ownership rights and consumer protection. The call to action encourages players to log off, refrain from playing or purchasing, cancel subscriptions, and essentially become invisible until Sony acknowledges its misstep.
This email reminder about the terms of service, while likely not intended to provoke, comes at a particularly ironic moment. With a protest against the shift to digital media scheduled from August 23 to August 30, fans are mobilizing to pressure Sony to reconsider its decision. One organizer expressed, “We want physical games to stay! A digital-only future without ownership & customer protection law is unacceptable!”
