iam8bit Files Lawsuit Against Skybound Game Studios Over Allegations of Fraud and Design Theft
Skybound Game Studios is facing a lawsuit from indie developer iam8bit, which accuses the studio of fraud and breach of contract, including the misappropriation of original designs. The parent company, Skybound Entertainment, is led by Robert Kirkman, known for creating _The Walking Dead_ comic series. As of now, Skybound has not responded to requests for comment regarding the lawsuit.
iam8bit, recognized for producing video games and merchandise like vinyl soundtracks, partnered with Skybound Game Studios in April 2021. The lawsuit claims that Skybound engaged in a multi-year accounting fraud, failing to deliver accurate financial reports as agreed. According to the complaint filed in the Los Angeles Superior Court, “Skybound failed to provide the monthly reports as agreed,” and allegedly inflated its expenses with millions in fictitious line items. iam8bit asserts that Skybound has not clarified these line items, even to an independent auditor they hired. The damages sought exceed $4 million due to these accounting discrepancies.
Additionally, iam8bit alleges that Skybound excluded them from a deal related to the indie game _Stray_. The complaint states that iam8bit created promotional materials for _Stray_’s launch on PlayStation and Xbox, but Skybound reportedly used confidential information about iam8bit’s royalty agreement with Annapurna Interactive to secure its own deal for the Nintendo version of the game. The lawsuit claims that Skybound utilized “almost exact copies” of iam8bit’s creative work for its marketing efforts.
The allegations in the lawsuit encompass breach of contract, fraud, conversion, unjust enrichment, and misappropriation. iam8bit’s legal team is pursuing monetary damages, punitive damages, and coverage for legal fees.
