Take-Two Seeks Court Approval to Subpoena Microsoft and Discord Records in GTA 6 Leak Investigation
Take-Two, the parent company of Grand Theft Auto’s Rockstar Games, has initiated several subpoena requests in federal court to gather information regarding the recent leak of GTA 6 gameplay videos. The company is seeking records from both Microsoft and Discord related to various online accounts that have been involved in sharing and posting these leaks ahead of the game’s anticipated November release. This includes user data and information about any linked OneDrive or Xbox accounts.
In a petition submitted to the Southern District Court of New York on August 20, Take-Two stated, “The copyrighted material includes but is not limited to audiovisual content, artwork, images, dialogue, or other creative elements.” The petition further explains that the purpose of the DMCA subpoena is to identify alleged infringers, with the assurance that the information will solely be used to protect Take-Two’s rights.
One of the petitions references a GitHub repository where infringing content was shared, giving Microsoft until September 4 to provide “all internal Microsoft business records and investigative records associated with Microsoft’s internal investigation of the ‘cyberleek’ persona sufficient to identify the user(s), person(s), and/or entity/ies associated with that persona.” It also requests:
All identifying information associated with all user accounts that are/were members communicating with the Discord server(s) listed below during the time period from June 1, 2026, to present; and for those accounts, provide any associated device/telemetry records where one or more of the tool/file artifacts below were present on the system. For each returned account, provide: the account ID, registration email, registration and last-login IP addresses, phone number, linked connections (Google/Xbox/etc.), any associated device identifiers (MachineGuid/MSA), and content related to Grand Theft Auto (‘GTA’), Rockstar, or Cyberleek from their OneDrive account.
Discord faces the same deadline to supply records concerning “all user accounts that are/were members communicating with the Discord server(s)” linked to “CYBERLEEK,” “CINEMATICROCKSTAR,” and “Surfer24k™ (+ replacement handles cyberleek_west, surwest),” as well as “Ødyssey.gg,” “‘! Odyssey’ public brand guild (discord.gg/odyssey),” and “DarkViperAU editors’ server (discord.gg/darkviperau).” The last server is associated with popular GTA 5 Twitch and YouTube streamer Matthew “Matt” Judge.
In response, Judge expressed his confusion on X, stating, “They’re asking for my discord info, I’m mentioned by name. I don’t know anything. That isn’t my editor’s discord. There aren’t even any clips of the leaks in either of my Discords. I am confused. I did say he can’t drive multiple times, so maybe I caused him to write ‘Cyberleek can’t drive’ on the most recent clips? Maybe he visited my Discord, I dunno. Rockstar hasn’t emailed me; I suspect if they thought I knew something personally they would do so. Everyone is talking about these leaks; I am not special, hopefully.”
The identity of the individual or group behind the dissemination of gameplay clips showcasing new features and unseen aspects of GTA 6 remains unknown, and Rockstar Games has yet to comment on the matter. The clips have been shared under the alias “Cyberleek,” originating from a site that has called for game companies to cease practices like digital pre-orders and locking completed content behind paywalls or as “fake” DLC. However, the individual or group appears to be leveraging these leaks to promote a cryptocurrency meme coin for potential profit.
